China proposes strict rules for digital humans to curb risks

Draft regulations mandate labelling, restrict content for minors, tighten AI governance

BEIJING: Cyberspace Administration of China has issued draft regulations to oversee the online development of “digital humans,” requiring clear labelling of virtual content and banning services that could mislead children or promote addiction.

According to the proposed rules, published for public comment until May 6, all virtual human content must carry prominent identification, while services offering “virtual intimate relationships” will be prohibited for users under 18.

The draft regulations also bar the use of personal data to create digital humans without consent and prohibit the use of such technology to bypass identity verification systems, reflecting China’s tightening oversight amid rapid advances in artificial intelligence.

Digital humans will not be allowed to disseminate content deemed harmful to national security, including material inciting subversion, promoting secession, or undermining national unity, the document stated.

Service providers have been advised to restrict content that is sexually suggestive, violent, or discriminatory based on ethnicity or region. They are also encouraged to intervene and provide professional assistance if users show signs of self-harm or suicidal tendencies.

The move comes as China accelerates adoption of AI technologies under its latest five-year development blueprint, while simultaneously strengthening regulatory frameworks to ensure safety and alignment with state policies.

Officials said the new rules aim to address regulatory gaps in the fast-growing digital human sector and establish clear boundaries for its development.

“The governance of digital virtual humans is no longer merely an issue of industry norms; rather, it has become a strategic scientific concern tied to cybersecurity, public interest, and the sustainable growth of the digital economy,” an official analysis noted.
