CDA Reverses Ban on Property Transfer Following IHC Directive

Relief for Hundreds of Buyers as Capital Development Authority Lifts Unofficial Restriction

Capital Development Authority (CDA) has revoked the ban on property transfer, following a directive from the Islamabad High Court (IHC).

The move comes as a relief to hundreds of buyers who were affected by the unofficial restriction, which was in place since January 2024.

Background:

The ban was initially imposed by the Deputy Director General Land in January 2024, targeting properties allocated to land affectees during the tenure of former Member Estate, Afnan Alam Khan.

However, it was extended to numerous other cases, causing uncertainty for buyers. The CDA had distributed plots through open auctions or allocated them to affected individuals, who later sold them on the open market.

Protests and Legal Action:

The Real Estate Agents Association had protested the ban, voicing concerns at the CDA premises.

Despite meetings with Chairman CDA and the then Member Estate, their grievances were not addressed.

Some individuals approached the IHC, which directed the CDA to begin property transfer to private individuals, asserting their right to ownership.

Skepticism Remains:

Despite the CDA issuing a notification, realtors remain skeptical of the authority’s intentions, suspecting that the notification was issued under pressure from the court.

They expect further clarity on the matter in the upcoming days.

The withdrawal of the ban by a junior officer raises suspicion, suggesting a reluctance from higher management to fully comply with court orders.

Investigation into Land Scandal:

Former Member Estate Afnan Alam Khan and several other officers of the land and rehabilitation directorate faced an investigation by the Federal Investigation Agency (FIA) over a scandal involving the alleged fraudulent allotment of land worth billions of rupees in sector E-11.

The FIA has sought comprehensive details of all allotments, plot location changes, and other relevant information from the CDA during his tenure.
